Terms of Use

1. Agreement to Terms

By accessing or using janeclapp.com (the "Site"), purchasing any digital product, or enrolling in any programme offered through this Site, you agree to be bound by these Terms of Use (the "Terms"). If you do not agree to these Terms, please do not use the Site or make a purchase.

These Terms constitute a legally binding agreement between you and Body Intelligence Inc., a corporation incorporated in Ontario, Canada ("we", "us", or "our"). Jane Clapp practises under the name Jungian Somatics.

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and applicable federal Canadian law, without regard to conflict of law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.

2. About This Site and Our Services

This Site provides information about Jane Clapp's professional services as a somatic therapist and Jungian analyst, and offers digital products including pre-recorded webinars and the Soul in Motion training programme. Nothing on this Site constitutes an offer of regulated health services or psychotherapy within the meaning of applicable Ontario legislation unless a formal therapeutic agreement has been separately established.

3. Not a Substitute for Professional or Medical Care

All content on this Site — including webinars, course materials, articles, and any other materials — is provided for educational and informational purposes only. It does not constitute psychotherapy, psychological treatment, medical advice, diagnosis, or treatment of any kind, and does not create a therapeutic or clinical relationship between you and Jane Clapp or Body Intelligence Inc.

Participation in somatic and Jungian-informed educational content may involve emotional material. You are solely responsible for assessing your own readiness and for seeking appropriate professional support if needed.

If you are experiencing a mental health crisis, suicidal ideation, or require immediate clinical support, please contact a qualified mental health professional, call 9-8-8 (Canada's Suicide Crisis Helpline), or contact your local emergency services.

4. Eligibility

You must be at least 18 years of age to use this Site, make a purchase, or enrol in any programme. By using this Site you represent and warrant that you meet this requirement. We reserve the right to refuse service to anyone for any reason at any time.

5. Digital Products — Pre-Recorded Webinars

When you purchase a pre-recorded webinar, you receive a personal, non-exclusive, non-transferable licence to access and view the recording for your own private, non-commercial use only. This licence does not transfer any ownership rights to you.

You may not:

  • Share, resell, sublicence, or redistribute the recording or any portion of it to any third party.
  • Use the content for commercial purposes, including in your own teaching or training, without prior written permission.
  • Screen-record, download, copy, or reproduce the material in any form.
  • Remove or alter any copyright, trademark, or proprietary notices.

Refund and cancellation policy: Webinar recordings are digital products delivered immediately upon purchase. In accordance with the Consumer Protection Act, 2002 (Ontario) and applicable federal consumer protection law, because you receive immediate access to a digital product, all sales are final once access has been delivered. If the recording is inaccessible due to a technical error on our part, we will either restore access or provide a full refund at our discretion. To report a technical issue, please contact us within 14 days of purchase through the contact form.

6. Soul in Motion Training Programme

Enrolment in the Soul in Motion training programme is subject to the specific terms communicated during the application and enrolment process, including any payment plan terms, programme policies, and the participant consent agreement. Those terms are incorporated into and form part of these Terms of Use. In the event of a conflict, the programme-specific terms prevail.

Payment plans: If you enrol on a payment plan, instalments are processed automatically via Stripe on the agreed schedule. It is your responsibility to ensure your payment method remains valid for the duration of the plan. Failure to maintain a valid payment method may result in suspension of access to programme materials.

Cancellation and refunds: Cancellation and refund terms for Soul in Motion are set out in the programme enrolment agreement. Where no specific terms apply, requests for refunds or cancellations must be submitted in writing through the contact form and will be considered on a case-by-case basis.

Programme access: Access to the participant portal and session materials is personal to you and may not be shared with or transferred to any other person.

7. Payments and Pricing

All prices are displayed in Canadian dollars (CAD) unless otherwise stated. Payment is processed by Stripe, Inc. By completing a purchase you agree to Stripe's Terms of Service. We reserve the right to correct pricing errors at any time prior to completing a transaction.

Applicable taxes (including HST where required) will be calculated and displayed at checkout.

8. Intellectual Property

All content on this Site — including text, images, video recordings, course materials, programme content, design, and branding — is the intellectual property of Body Intelligence Inc. (Jane Clapp) or is used with permission, and is protected by Canadian and international copyright law. All rights are reserved.

You may not reproduce, distribute, publicly display, create derivative works from, or otherwise use any content from this Site for any purpose without our prior written consent, except as expressly permitted by the licence granted in Section 5 above or as permitted by applicable law (including fair dealing under the Copyright Act (Canada)).

12. Limitation of Liability

To the fullest extent permitted by applicable law, Body Intelligence Inc. and Jane Clapp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, arising out of or in connection with your use of or inability to use this Site, its content, or any products or services purchased through it, even if advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or your use of the Site shall not exceed the amount you paid to us in the 12 months preceding the claim, or CAD $100, whichever is greater.

Nothing in these Terms limits or excludes liability that cannot be excluded under applicable Canadian consumer protection law, including the Consumer Protection Act, 2002 (Ontario).

13. Indemnification

You agree to indemnify, defend, and hold harmless Body Intelligence Inc., Jane Clapp, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

14. Privacy

Where changes are material, we will take reasonable steps to notify users. Continued use of the Site after an update constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any programme-specific enrolment terms, constitute the entire agreement between you and Body Intelligence Inc. with respect to your use of this Site and supersede all prior agreements, representations, and understandings.
